Residential conveyancers say they are preparing for the Government's buying and selling reforms well ahead of legislation, with change promised by the end of the current parliament. Phased introduction expected

Reform is expected to arrive in phases, with sales packs likely to be mandated well before early binding agreements. The Government's own timing remains uncertain. The MHCLG has stated that sales packs will be mandated "when Parliamentary time allows", although it is working with industry to identify information that can be provided voluntarily straight away to support more efficient transactions and help sector professionals — including estate agents — adjust ahead of legislation.

The word "voluntary" features heavily in the published roadmap, with the industry asked to informally prepare consumers ahead of any law change.

A united legal front

The Negotiator reports that conveyancers are at the front of the pack, with every representative spoken to fully supporting the Government's direction and presenting a united front. The Government has described the reforms as a "once in a generation" change, with two broad objectives: educating the public and reforming industry processes.

Conveyancers agree a collaborative, collective approach is needed. Janine Wellington of Convey Law said a successful reform programme would require a clear public education campaign, arguing that providing information upfront is not an additional burden but a proven way to reduce delays, uncertainty and failed transactions. Ben Ridgway at iamproperty echoed this, saying government, conveyancers, agents, surveyors, lenders, portals and technology providers should reinforce the same message through a coordinated public-awareness campaign.

The education challenge for agents

A mass campaign may only go so far. The most recent English Housing Survey shows homeowners with an outstanding mortgage move an average of every 8.9 years, while those without a mortgage stay put for 23.7 years. A campaign lasting two or three years will mean little to settled homeowners, leaving the education work to agents and conveyancers who deal with the public at the point of transaction.

Rob Gurney of Ochresoft noted that conveyancing is often misunderstood and the current process is already unfamiliar to many, so simply telling consumers the process has changed is unlikely to shift perspectives. He favours estate agents leading the education effort, since in the vast majority of transactions the agent interacts with the consumer first and the lawyer is instructed afterwards.

For letting agents and inventory clerks, sales-focused reforms — including mandated sales packs — could reshape how information is gathered and shared at the very start of a transaction, and the profession is expected to help prepare consumers voluntarily in the meantime.
