A recent survey has revealed that almost seven in ten private renters in England are unaware of, or do not understand, the Renters’ Rights Act. The research, commissioned by the TDS Charitable Foundation, highlights a significant lack of awareness among tenants about the most substantial reforms to the private rented sector in decades.
The survey, conducted with over 2,000 private renters shortly before the Act began to be implemented on 1 May, found that 69% had either never heard of the Renters’ Rights Act or were unsure what it meant. Only 32% of respondents said they were aware of the legislation and understood at least some of its implications.
The findings indicate that many tenants may not be aware of new legal protections introduced under the Act. These include the abolition of Section 21 ‘no fault’ evictions, restrictions on rent increases, and measures designed to prevent rental bidding wars.
Awareness was found to be particularly low among certain groups, including students, low-income renters, and those living in bedsits or shared accommodation. Nearly half (47%) of students surveyed said they had never heard of the legislation.
The research also showed limited awareness of the tribunal process available to tenants who wish to challenge above-market rent increases. Almost four in five respondents (78%) said they were unaware of the tribunal responsible for hearing such cases.
Additionally, just 14% of renters said they intended to seek permission to keep a pet as a result of the reforms, suggesting that this aspect of the Act may have a more limited impact.
These findings are relevant for letting agents and inventory clerks, as they highlight the need for increased communication and education about the new legal landscape in the private rented sector. Ensuring tenants are informed about their rights and the changes brought by the Renters’ Rights Act will be crucial as the reforms continue to be implemented.
